Terms of service.

1. Agreement to these terms

These Terms of Service (“Terms”) form a binding agreement between you and Nunca, operated by Yzzy LLC, a California limited liability company. Contact: hi@nunca.app. By using nunca.app you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

You must be at least 13 years old to use Nunca. Users in the European Union must be at least 16 or have parental consent per local law.

2. What Nunca does

Nunca is a free AI-assisted TV show recommendation service. You react to 12 shows during a short profiling flow; we ask an AI model to infer your taste and suggest 15 shows you might enjoy. You can optionally sign in with Google to save your taste across devices and sessions.

3. AI output — nature and limits

Recommendations and your “taste DNA” text are generated by a large language model. They are suggestions, not objective fact or expert advice. They may be incorrect, incomplete, or reflect biases of the underlying model. Platform-availability data comes from third-party content metadata services; streaming services add and remove shows all the time and the data can lag. Always verify availability in your region before committing to a platform.

4. Your account (optional)

Sign-in is entirely optional. If you do sign in with Google, you are responsible for maintaining access to that Google account. We use your Google identity only to save your Nunca taste and session history. You can sign out any time, and you can request full deletion at hi@nunca.app.

5. Acceptable use

You may use Nunca for personal, non-commercial viewing discovery.

You agree not to:

• Scrape, reverse-engineer, or automate interactions with the service (including AI-agent browsing, bots, or API hammering).
• Use Nunca to generate content for resale or competing recommendation products.
• Circumvent rate limits, bot protections, or security mechanisms.
• Transmit malware, abusive content, or unlawful material through any Nunca surface (including comments or feedback channels).
• Use Nunca to infringe the intellectual property of third parties.

We may suspend or terminate access immediately if you breach this section.

6. Intellectual property

The Nunca name, logo, visual design, code, and other creative output of the service are our intellectual property or the property of our licensors. No license is granted except the limited personal-use license in these Terms.

Show metadata, posters, and images shown in Nunca come from third-party content services (including TMDB and OMDB) and the respective streaming services, and remain the property of their owners. Nunca uses the TMDB API but is not endorsed or certified by TMDB.

The reactions you give, and the DNA generated from them, remain yours. We only use them to provide the service to you and, in anonymized aggregate form, to improve the service.

7. Third-party services — no affiliation

Nunca is not affiliated with, sponsored by, or endorsed by Netflix, Amazon Prime Video, Disney+, HBO Max, Apple TV+, Paramount+, Hulu, Peacock, Starz, AMC+, Crave, Claro Video, ViX, Movistar+, DIRECTV GO, Sky Go, ITVX, or any other streaming service. Links to those platforms are provided for convenience only.

8. Warranty disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY OF RECOMMENDATIONS. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NUNCA, ITS OPERATOR, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS CAPPED AT FIFTY U.S. DOLLARS (US$50).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages; in those jurisdictions, our liability is limited to the maximum extent permitted.

10. Indemnification

You agree to defend, indemnify, and hold harmless Nunca and its operator from any claim arising out of your breach of these Terms or your unlawful use of the service.

11. Termination

We may suspend or terminate your access at any time, with or without notice, for conduct that we believe violates these Terms or harms the service or other users. You can stop using Nunca at any time and request deletion of any data associated with your use.

12. Governing law and dispute resolution

These Terms are governed by the laws of the Dominican Republic, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the service will be resolved exclusively in the courts of Santo Domingo, Dominican Republic, except where your local consumer-protection law requires otherwise.

If you are in the European Union, you retain the right to bring proceedings before your local court in accordance with applicable consumer-protection laws.

13. Modifications to the service and these Terms

We may modify, suspend, or discontinue any feature of Nunca at any time without notice. We may update these Terms; for material changes we will update the “Last updated” date at the top of this page. For changes that significantly affect your rights, we will also notify you by email if you have provided one. Continued use after an update means you accept the revised Terms.

14. Severability and entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. These Terms together with the Privacy Policy constitute the entire agreement between you and Nunca regarding the service.
